1.    AGREEMENT TO TERMS OF USE

These Terms of Use (or “Terms”) constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“You”) and KEIFFEL TOURS LTD (“KEIFFEL TOURS”, “we,” “us,” or “our”), concerning your access to and use of the keiffeltours.mu / www.keiffeltours.mu website, being this website, as well as any other media form, media channel or mobile website, linked, or otherwise connected thereto (collectively, the “Site”). 

We are a private company, limited by shares, registered under the laws of Mauritius, under Company Number and Business Registration Number (BRN), C10042944. Our registered office is at—Rue De La Salette, Grand Bay, Mauritius (pin location). We provide to individuals and/or entities (the “Merchant/s”) a virtual space on our Site, for the purpose of listing the Merchant products and/or services.

You agree that by accessing the Site, You have read, understood, and agreed to be bound by all of these Terms of Use.

IF YOU DO NOT AGREE WITH ANY AND/OR ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time and for any reason. Please ensure that You check the applicable Terms every time You use our Site so that You understand which Terms apply. You will be subject to, will be deemed to have been made aware of, and to have accepted, the changes in any revised Terms by your continued use of the Site after the date such revised Terms are posted.

The information provided on the Site is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Site from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

The Site is intended for users who are physically and mentally capable persons of at least 18 years old acting in their own capacity. Persons under the age of 18 are not permitted to use or register (by creating an account) for the Site.

2.  TERMS OF SALE

Services / Offers that You buy through keiffeltours.mu are subject to the terms below:

• All prices are catalogued in Mauritian rupees.
• All prices are inclusive of VAT at the applicable rate at the time of your order.
• Offers and Services, once sold are not exchangeable and are non-refundable.
• When making a purchase, you accept the applicable policies as displayed in the purchase process.
• If you cancel a purchase, or do not show up, any cancellation no show fee or refund will depend on Keiffel Tours no-show policy.
• Some purchases cannot be cancelled for free, while others can be cancelled for an additional charge representing 10% of the order before a deadline. 
• Once purchase is complete, if ever, You wish to cancel, postpone, amend or change anything within an order, there will be an additional fee of 10% to be paid on subtotal of that product id. Note any amendment is not guaranteed and is subject to the written authorization.
• You will be required to read and accept the terms and conditions which are displayed on our website before making a purchase. Once the purchase has been made, You and the Merchant will be bound by such terms and conditions.
  • If for extenuating circumstances a refund is given, the user is required to send bank details immediately to info@keiffeltours.mu . Keiffel Tours will finalise all refunds.
• Keiffel Tours does NOT guarantee its clients against pricing errors or issues with regards to programming, technological and computer issues.
• Deals are redeemable for certain services or experiences offered by, or facilitated through, the Merchant identified on the offer. The Merchant is solely responsible for redeeming the offer. The Merchant is the issuer of the deal and is solely responsible for all goods and services provided to You and for any and all injuries, illnesses, damages, claims, liabilities and costs (“Liabilities”) it may cause You to suffer, directly or indirectly, in full or in part, whether related to the use or redemption of a deal or not.
• When You make a purchase, it is directly with the Merchant. MariDeal is NOT a contractual party to the purchase or order.
• When rendering our services, the information that we disclose is based on the information provided to us by Suppliers (leisure partners). As such, the Suppliers are responsible for updating information which is displayed on our Platform. We will use reasonable skill and care in performing our services and do not guarantee that, all information is accurate, complete, or correct. Our Platform does not constitute and should not be regarded as a recommendation or endorsement of the quality, service level, qualification, or star rating of any Supplier (or its facilities, venue, products, or services) made available.
• It is strictly prohibited to purchase any offer or service on Keiffel Tours and resell said offer to a third party. Our Service is made available for personal and non-commercial use only. Therefore, You are not allowed to resell, deep-link, use, copy, monitor, display, download or reproduce any content or information, software, reservations, tickets, products or services available on our Platform for any commercial or competitive activity or purpose.
• Any attempt to redeem a service or offer in violation of these Terms will render the service or offer purchased void. These rules apply to all promotional deals that we make available, unless a particular deal’s “Deal Conditions” states otherwise, and except as otherwise required by law. In the event of a conflict between these rules and a deal’s conditions, the deal’s conditions print will control.
• Keiffel Tours may, in its sole discretion, verify a user’s identity prior to processing a purchase. In addition we may also refuse to process, or may cancel, a purchase, as reasonably deemed necessary to comply with applicable law or to respond to cases of misrepresentation, fraud, or known or potential violations of the law or these Terms of Use.
• You waive and release Keiffel Tours from any Liabilities arising from or related to any act or omission of a Merchant in connection with your use of an offer or the goods or services it provides.
